Fluidra is a global manufacturer of residential pool equipment and connected pool solutions. The Fluidra family of brands includes Jandy, Polaris, Zodiac, iAquaLink, Cover-Pools, Nature2, Caretaker, Baracuda, SAVI, and Grand Effects. This Privacy Policy describes the practices of Zodiac Pool Systems LLC, a Fluidra company, in North America and its affiliated entities (collectively, “Fluidra,” “we,” “us,” or “our”) in connection with information that we collect through https://www.fluidrausa.com and the other websites operated by us from which you are accessing this Privacy Policy (the “Websites”), through the software application made available by us for use on or through computers and mobile devices (the “App”), through our social media pages that we control from which you are accessing this Privacy Policy (“Social Media Pages”), through HTML-formatted email messages that we send to you that link to this Privacy Policy, through our pool automation systems and other connected products and services (the “Connected Products”), and through our offline communications with you in connection with your interest in or use of our products and services (collectively, including the Websites, the App, our Social Media Pages, email messages, Connected Products and offline communications, the “Services”).

Personal Information

"Personal Information" is information that identifies you as an individual or relates to an identifiable individual, including:

  • Name;
  • Postal address (including billing and shipping addresses);
  • Telephone number;
  • Internal account ID, username, and password;
  • Email address; and
  • Credit and debit card numbers.

We may need to collect and process these types of Personal Information in order to provide the requested Services to you, or because we are legally required to do so. If you do not provide the information that we request, we may not be able to provide you with the requested Services.

Collection of Personal Information

We and our service providers may collect Personal Information in a variety of ways, including:

  • Through the Services: We may collect Personal Information through the Services. For example, we may collect Personal Information when you request information or sign up for a newsletter through our Websites, when you use our Social Media Pages, or when you register or create an account in connection with our App or Connected Products, or when you contact us for customer or technical support.

If you wish to make a payment through the Services, your Personal Information may be collected by such third party and not by us, and will be subject to the third party’s privacy policy, rather than this Privacy Policy.

If you disclose any Personal Information relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

Use of Personal Information

We and our service providers may use Personal Information for our legitimate business interests, including the following:

  • To respond to your inquiries and fulfill your requests, complete your transactions and provide you with related customer service. We will engage in these activities to manage our contractual relationship with you or to comply with a legal obligation.

If we are required to treat Other Information as Personal Information under applicable law, then we may use and disclose it for the purposes for which we use and disclose Personal Information as detailed in this Policy.

Collection of Other Information

We and our service providers may collect Other Information in a variety of ways, including:

  • Through your browser or device: Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version and the name and version of the Services (such as the App) you are using. We use this information to ensure that the Services function properly.
  • Through your use of the App: When you download and use the App, we and our service providers may track and collect App usage data, such as the date and time the App on your device accesses our servers and what information and files have been downloaded to the App based on your device number.
  • Using cookies: Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Services, pages visited, language preferences and other anonymous traffic data. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, and to personalize your experience. We also gather statistical information about use of the Services in order to continually improve their design and functionality, understand how they are used and assist us with resolving questions regarding them. Cookies further allow us to select which of our advertisements or offers are most likely to appeal to you and display them while you are on the Services. We may also use cookies or other technologies in online advertising to track responses to our ads. If you do not want information collected through the use of cookies, most browsers allow you to automatically decline cookies or be given the choice of declining or accepting a particular cookie (or cookies) from a particular website.   • Using pixel tags and other similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used to, among other things, track the actions of users of the Services (including email recipients), measure the success of our marketing campaigns and compile statistics about usage of the Services and response rates.
  • Analytics: We use Google Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends. This service may also collect information regarding the use of other websites, apps and online resources.   • Using Adobe Flash technology (including Flash Local Shared Objects ("Flash LSOs")) and other similar technologies: We may use Flash LSOs and other technologies to, among other things, collect and store information about your use of the Services. If you do not want Flash LSOs stored on your computer, you can adjust the settings of your Flash player to block Flash LSO storage using the tools contained in the Website Storage Settings Panel. You can also go to the Global Storage Settings Panel and follow the instructions (which may explain, for example, how to delete existing Flash LSOs (referred to as"information", how to prevent Flash LSOs from being placed on your computer without your being asked, and how to block Flash LSOs that are not being delivered by the operator of the page you are on at the time). Please note that setting the Flash Player to restrict or limit acceptance of Flash LSOs may reduce or impede the functionality of some Flash applications.
  • IP Address: Your IP address is automatically assigned to your computer by your Internet Service Provider. An IP address may be identified and logged automatically in our server log files whenever a user accesses the Services, along with the time of the visit and the page(s) that were visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications and other services. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems and administering the Services. We may also derive your approximate location from your IP address.
  • Through Connected Products: We may collect information pertaining to the configuration and use of a Connected Product, such as how a Connected Product is configured for a particular location and or use (e.g., pump schedules and temperature set-points), as well as operational data such as information describing the operational state and performance of a Connected Product at a particular moment in time, such as pump speed or power consumption of a Connected Product.

Uses and Disclosures of Other Information

We may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. In some instances, we may combine Other Information with Personal Information. If we do, we will treat the combined information as Personal Information as long as it is combined.

Third Party Services

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.

In addition, we are not responsible for the information collection, use, disclosure or security policies or practices of other organizations, such as Facebook, Apple, Google, LinkedIn, Twitter, Microsoft, RIM or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer, including with respect to any Personal Information you disclose to other organizations through or in connection with the App or our Social Media Pages.

Third Party Advertising

We may use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you when you access and use the Services and other websites or online services, based on information relating to your access to and use of the Services and other websites or online services on any of your devices, as well as on information received from third parties. To do so, these companies may place or recognize a unique cookie on your browser (including through the use of pixel tags). They may also use these technologies, along with information they collect about your online use, to recognize you across the devices you use, such as a mobile phone and a laptop. We seek to use reasonable organizational, technical and administrative measures to protect Personal Information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. Choices and Access

If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out by clicking the opt-out mechanism provided in each of these emails.

We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt-out.

We will try to comply with your request as soon as reasonably practicable.

Please note that we may need to retain certain information for record keeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g., when you make a purchase or enter a promotion, you may not be able to change or delete the Personal Information provided until after the completion of such purchase or promotion). There may also be residual information that will remain within our databases and other records, which will not be removed.

Retention Period

We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

We will verify and respond to your request consistent with applicable law, taking into account the type and sensitivity of the Personal Information subject to the request. We may need to request additional Personal Information from you, such as mailing address, telephone number and/or email address, in order to verify your identity and protect against fraudulent requests. If you maintain a password-protected account with us, we may verify your identity through our existing authentication practices for your account and require you to re-authenticate yourself before disclosing or deleting your Personal Information. If you make a deletion request, we may ask you to verify your request before we delete your Personal Information.

You have the right to be free from unlawful discrimination for exercising your rights under the CCPA.

Authorized Agents

If you want to make a request as an authorized agent on behalf of a California resident, you may use the submission methods noted above. As part of our verification process, we may request that you provide, as applicable, proof concerning your status as an authorized agent, which also may include:

Terms & Conditions

This Fluidra User Agreement (the "User Agreement") sets forth the terms and conditions which apply to your use of the Fluidra Websites (defined below). By using the Fluidra Websites, you agree to the terms of this User Agreement just as if you had signed the User Agreement. If you do not agree to the terms and conditions contained herein, you should terminate use of the Fluidra Websites immediately.

Zodiac Pool Systems LLC, a Fluidra company, or any of its related, affiliated or subsidiary companies, (together, "Fluidra"), reserves the right to modify or amend the User Agreement at any time without prior notice. By accessing the Fluidra Websites you signify your agreement to this User Agreement as it has been modified or amended.

Restrictions on Use
Material from www.fluidrausa.com and other websites owned, operated, licensed, or controlled by Fluidra, its related, affiliated or subsidiary companies (together, the "Fluidra Websites"), may not be copied, distributed, republished, uploaded, posted, or transmitted in any way, without prior written consent of Fluidra.

EXCEPTIONS: Product sell sheets, brochures, and manuals may be downloaded for their intended use, provided that you do not delete or change any copyright, trademark or other proprietary information or notices. Modification or use of the materials for any other purpose violates Fluidra's intellectual property rights.

The material on this site is provided for lawful purposes only. If you download software from our site, the software, including all files, images, contained in or generated by the software, and accompanying data (together, the "Software") are deemed to be licensed to you by Fluidra. Neither title nor intellectual property rights are transferred to you, but remain with Fluidra, who owns full and complete title. This Fluidra Pro Academy User Agreement (the "User Agreement") sets forth the terms and conditions which apply to your personal use of the items, documents and information contained on the Fluidra Pro Academy Website.
